1. Agreement to Terms

By accessing or using Aemira AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

Aemira AI is a product of The Call Center Wizards LLC, a New Jersey Limited Liability Company ("Company", "we", "us", or "our").

Important Billing Information:

All charges are processed by The Call Center Wizards LLC. Charges will appear as "The Call Center Wizards LLC" on your credit card statement.

3.1 Subscription Plans

We offer monthly subscription plans with varying conversation limits and features. Current plan options and pricing are available on our pricing page.

3.2 Free Trial

New users receive a 14-day free trial. No credit card is required for the trial period. After the trial ends, you must subscribe to a paid plan to continue using the Service.

3.3 Automatic Renewal

Subscriptions automatically renew on a monthly basis unless canceled. You will be charged at the beginning of each billing cycle. You can cancel at any time from your billing settings.

3.4 Payment Methods

We accept major credit cards and debit cards through our payment processor, Stripe. You agree to provide accurate and complete payment information.

3.5 Failed Payments

If your payment fails, we will notify you via email. Your access may be suspended until payment is successfully processed. We reserve the right to terminate accounts with repeated payment failures.

3.6 Overage Packs

If you exceed your plan's conversation limit, you may purchase additional conversations through one-time overage packs. These are non-refundable.

4. Cancellation & Refunds

4.1 Cancellation Policy

You may cancel your subscription at any time from your billing settings. Cancellations take effect at the end of your current billing period. You will retain access to the Service until the end of the paid period.

4.2 No Partial Refunds

We do not provide refunds for partial months of service. If you cancel mid-cycle, you will retain access until the end of your billing period, but no refund will be issued.

4.3 Trial Conversions

If you upgrade from a free trial to a paid plan before the trial ends, the remaining trial days are forfeited, and no refund is provided.

Your plan includes a specific number of conversations per month. A "conversation" is defined as a complete interaction between a user and your chatbot, which may include multiple messages.

6. Data & Privacy

6.1 Your Data

You retain all rights to the content you upload, including knowledge sources, training materials, and conversation data. We do not claim ownership of your data.

6.2 Data Security

We use industry-standard encryption and security measures to protect your data. However, no method of transmission over the internet is 100% secure. You use the Service at your own risk.

6.3 Data Usage

We may use aggregated, anonymized data for service improvement, analytics, and research. We will never share your identifiable data with third parties without your consent, except as required by law.

6.4 Data Deletion

Upon account termination, we will delete your data within 90 days, except where required by law to retain it longer. You may request immediate data deletion by contacting support.

7. Intellectual Property

7.1 Our Rights

The Service, including all software, designs, text, graphics, and trademarks, is owned by The Call Center Wizards LLC and protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.

You retain all rights to your content. By using the Service, you grant us a limited license to use, store, and process your content solely to provide the Service.

8. Disclaimers & Limitations of Liability

8.1 Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be error-free, uninterrupted, or meet your specific requirements.

8.2 AI Limitations

Aemira AI uses artificial intelligence technology, which may occasionally produce inaccurate, incomplete, or inappropriate responses. You are responsible for reviewing and validating all AI-generated content before using it.

8.3 Limitation of Liability

To the maximum extent permitted by law, The Call Center Wizards LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

8.4 Maximum Liability

Our total liability to you for all claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Service Availability & Maintenance

9.1 Uptime

While we strive for high availability, we do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or unforeseen circumstances.

9.2 Scheduled Maintenance

We will provide advance notice of scheduled maintenance when possible. Emergency maintenance may occur without notice.

9.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We are not liable for any modifications or discontinuations.

You may terminate your account at any time by canceling your subscription from the billing settings or contacting support.
